Forxers Terms and Conditions
1. Introduction
Welcome to Forxers, a Nigerian forex education platform and community. These Terms and Conditions (“Terms”) govern your access to and use of all Forxers services, including our website (when available), Discord community server, and any content, features, or communications provided (collectively, the “Platform” or “Services”). By accessing or using Forxers, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy (available on our site). If you do not agree with any part of these Terms, please do not use the Platform.
These Terms constitute a binding agreement between you (the “User”) and Forxers (the “Company,” “we,” “us,” or “our”). Forxers provides educational resources and a community for learning about foreign exchange (forex) trading. All information on Forxers is for educational purposes only and does not constitute financial or investment advice. We emphasize that we are not a financial advisory service or broker. Details on disclaimers and risk are provided in later sections. Please read these Terms carefully and contact us if you have any questions.
Note: Currently, our community operates primarily via a third-party platform (Discord). By joining and participating in the Forxers Discord server or any interim platform, you also agree to comply with Discord’s Terms of Service and Community Guidelines, in addition to these Terms. We are in the process of developing a custom Forxers website/platform; these Terms will continue to apply to our services through Discord and will be updated as needed when our own platform is launched.
2. Eligibility and Age Requirement
2.1 Minimum Age: To use the Forxers Platform or participate in our community, you must be at least 16 years old. By creating an account or accessing our Services, you represent and warrant that you are 16 or older. If you are under 16, you are not permitted to use Forxers.
2.2 Parental Consent for Minors: If you are between 16 and 18 years of age (or under the age of legal majority in your jurisdiction), you should review these Terms with a parent or legal guardian. By using Forxers, we assume that you have consent from your parent/guardian to be here. We do not knowingly collect personal information from anyone under 16.
2.3 Legal Capacity: You also represent that you are fully able and competent to enter into and comply with these Terms. You are not barred from using the Platform under any applicable laws – for example, you are not on any trade or economic sanctions lists that would prevent use of an educational service.
3. Account Registration and Security
3.1 Account Creation: In order to access certain Services (such as participating in the community forums or subscribing to premium content), you may need to create an account with Forxers or register via our designated platforms. Currently, joining our Discord server constitutes account creation for community access. In the future, account registration may occur through our own website. You agree to provide accurate, current, and complete information during registration and to keep your account information updated as needed.
3.2 Account Credentials: You are responsible for maintaining the confidentiality of any login credentials (such as Discord account details or future Forxers site username/password) and for restricting access to your account. You agree not to share your account with others. You must notify us immediately at our support contact (see Section 18) if you suspect any unauthorized use of or access to your account. Forxers will not be liable for any loss or damage arising from your failure to safeguard your credentials.
3.3 One Account Per User: Unless expressly permitted by us, each user should maintain only one account. Creating multiple accounts to circumvent restrictions or gain additional benefits is considered misuse and can lead to suspension (see Section 12).
3.4 Account Responsibility: All activities undertaken through your account (including posts, messages, and transactions) are deemed to be done by you. You are responsible for any content you post and any actions taken under your account, whether or not authorized by you. Ensure that you properly log out and secure your account, especially when using a shared device.
4. Platform Access and Community (Discord Usage)
4.1 Discord Community Platform: Forxers’ educational community currently operates primarily on a Discord server. This means that much of our interaction, content sharing, and mentoring occurs on Discord. By joining the Forxers Discord server or any other official community channel we provide, you agree to abide by all rules in these Terms as well as Discord’s own policies. Discord is a third-party service, and your use of Discord is subject to Discord’s Terms of Service and Community Guidelines. We have no control over Discord’s platform, so please familiarize yourself with their rules as well.
4.2 Joining and Participating: To join our Discord community, you will need a valid Discord account. When you join, you must follow any verification or onboarding steps we have in place (for example, agreeing to community rules or verifying your email). Community interaction is a core part of Forxers, and respectful participation is expected (see Section 5 on Community Guidelines).
4.3 Third-Party Platform Disclaimer: While we moderate and manage our Discord community, Discord itself is not operated by Forxers. Therefore, we are not responsible for Discord’s uptime, security, or any data breaches or issues that originate from Discord’s side. We will do our best to maintain a safe community space, but note that we cannot guarantee Discord’s performance or availability at all times. Occasional outages or interruptions on Discord’s network or servers are beyond our control.
4.4 Transition to Custom Platform: As noted, Forxers plans to launch its own dedicated platform/website for our community and courses. Until our custom site is ready, Discord remains the primary venue. When the new platform is introduced, we will provide instructions for users to transition (e.g., creating a new account on our site or linking existing membership). These Terms (including user conduct rules, content guidelines, etc.) will equally apply on the new platform. We will update or supplement these Terms at that time and notify users of any significant changes.
5. Community Guidelines and Acceptable Use
We strive to maintain a welcoming, safe, and focused learning community. By participating in the Forxers Platform (including Discord discussions, forums, chat rooms, etc.), you agree to adhere to the following community guidelines and acceptable use policies:
- Respect Others: Treat all members, mentors, and staff with respect and civility. Harassment, bullying, hate speech, or discrimination of any kind (including on the basis of race, ethnicity, gender, religion, nationality, or any other characteristic) is strictly prohibited.
- No Fraudulent or Illegal Content: You must not post or share any content that is unlawful, fraudulent, defamatory, libelous, or that infringes on anyone’s rights. This includes not sharing content that violates copyright, trademark, or other intellectual property rights you do not own.
- No Financial or Investment Promises: While discussing trading is encouraged, do not promise profits or guaranteed returns to other users. No member should solicit investments or offer financial products/advice to others in the community. Remember, our platform is for education – personal advertising of investment schemes or giving others specific trading instructions could violate our “no financial advice” policy and regulatory laws.
- No Spam or Unsolicited Promotion: Do not use the community to spam, advertise unrelated products/services, or excessively self-promote. We welcome sharing of helpful resources, but posting repetitive links, promotional content, or referral codes without context or permission will be considered spam.
- Appropriate Content: Keep discussions relevant to forex trading, investing education, and related topics. Do not post obscene or pornographic material, excessively graphic content, or anything that a reasonable person would consider highly offensive or not suitable for a professional learning environment.
- No Impersonation or Misrepresentation: Do not impersonate any person or entity (including Forxers staff or any other individual), or falsely claim an affiliation. Also, do not misrepresent your own experience or credentials. Honesty helps maintain trust in the community.
- Cybersecurity and Integrity: You must not attempt to disrupt or hack the Platform. This includes not distributing viruses or malicious code, not attempting to gain unauthorized access to other users’ accounts or our systems, and not engaging in any activity that could damage or impair the Platform’s functionality (e.g., denial of service attacks).
- Follow Additional Guidelines: From time to time, we may publish specific community guidelines, house rules, or codes of conduct (for example, pinned messages in the Discord server or a guidelines page on our site). These are considered part of the acceptable use policy. You agree to follow those as well.
Enforcement: Violation of the above guidelines or other aspects of these Terms may result in content removal, warnings, or account deactivation/termination (see Section 12). We reserve the right to remove any content or take action against any account that, in our judgment, violates these rules or is otherwise objectionable, without prior notice. We also reserve the right to involve law enforcement if user content or behavior involves suspected criminal activity. Forxers staff and moderators may monitor interactions and will use their discretion to maintain a positive learning environment.
6. User-Generated Content and License
6.1 Your Content: “User-Generated Content” (UGC) means any content that you or other users post, upload, share, or otherwise make available on the Forxers Platform. This includes, for example, text postings in forums or chat, messages, images, shared documents, analysis, or any other materials contributed by users. You retain ownership of any original content that you post. We do not claim ownership of your ideas or content. However, by submitting or posting content on the Platform, you are granting Forxers certain rights as described below.
6.2 License Grant to Forxers: By posting or sharing content, you grant Forxers a worldwide, royalty-free, non-exclusive, sublicensable and transferable license to use, reproduce, distribute, display, and create derivative works of your content in connection with operating and promoting the Platform. This license is necessary for us to, for example, display your posts to other community members, feature a great testimonial in our marketing (with attribution), or back up our systems. We will never sell your personal content to third parties, but you do allow us to use what you post within the scope of our services. This license continues even if you remove your content or terminate your account, but we will remove public-facing content at your request if you leave (if feasible), except to the extent it has been shared by others or archived as part of platform backups.
6.3 Your Responsibilities for Content: You are solely responsible for the content you contribute. You represent and warrant that: (a) you have all necessary rights to post the content (it is your original work or you have permission); (b) your content does not infringe or violate the rights of any third party (including intellectual property, privacy, or publicity rights); (c) your content is not unlawful, misleading, or harmful; and (d) your content complies with these Terms and any community guidelines. You agree that if any of your content is found to be in violation, we may remove or disable it and, if warranted, take action against your account.
6.4 Public Nature of Community Content: Understand that content you post in the community (Discord channels, forums, etc.) may be visible to other members of Forxers (and potentially to the public, if channels are public). Even in a “members-only” area, other subscribers will see your posts. Do not share confidential information or anything you wouldn’t want others to see. Forxers is not responsible for controlling how other members might use the information you voluntarily share (for example, someone could copy and re-share your trading tip externally – we discourage this, but we cannot absolutely prevent it). Please exercise discretion in what you share.
6.5 No Endorsement: Forxers does not pre-approve user content and does not endorse or verify the accuracy of any user-generated posts, statements, or claims. Opinions expressed by users are their own. We are not liable for any errors or omissions in user content, nor for any losses or damages incurred as a result of reliance on user content. Use information from other users at your own risk. We highly recommend doing your own research or verifying information from multiple sources before acting on any trading idea shared by another member.
6.6 Content Moderation: While we are not obligated to monitor every post, we reserve the right to review, screen, and delete any user content at any time at our discretion. This might happen if we receive complaints, or if we independently determine content violates these Terms or applicable law. We may also edit or remove content that contains excessive advertising or off-topic material. You acknowledge that Forxers has the right (but not the obligation) to monitor communications posted on the Platform and to remove any content or ban any users that we in our sole discretion believe may violate these Terms or our community standards.
6.7 Feedback: If you submit suggestions, ideas, feedback, or other information to Forxers about our Platform (“Feedback”), such Feedback is entirely voluntary and we are free to use it as we see fit, without any obligation to you. For example, if you suggest we add a feature and we implement it, we do not owe you compensation. We appreciate Feedback as it can help improve our Services.
7. Educational Purpose Only – No Financial Advice
Forxers is an educational platform for learning about forex trading. All content, discussions, tutorials, strategies, indicators, and any other information provided through our Services are for educational and informational purposes only. By using Forxers, you acknowledge and agree to the following:
- No Professional Advice: Forxers is not a licensed financial advisor, broker/dealer, or investment advisory service. Nothing on our Platform constitutes professional financial advice, investment advice, or an invitation to trade in any financial instrument. We do not provide personalized investment recommendations or advice tailored to your individual situation.
- Independent Decisions: Any actions you take in the foreign exchange market (or any financial market) are solely your decision and at your own risk. You should consider seeking advice from a qualified financial advisor before making investment decisions. Do not rely on any single source of information, including Forxers, to make financial decisions.
- No Advisor-Client Relationship: Your use of Forxers does not create any fiduciary relationship between you and us. Forxers and its mentors or instructors may share general trading knowledge, example analyses, or personal opinions, but these are not individualized recommendations. We are educators, not your financial planners or brokers.
- Community Content Caution: Other users may share their personal trading ideas or results; treat these as opinions, not fact. Forxers does not endorse or verify any user’s claims of success. Always use your own judgment and analysis. Paper trade or simulate strategies first if you wish to test ideas learned, rather than risking real money immediately.
By acknowledging these Terms, you also acknowledge that any trades you place or investments you make based on information from Forxers are made at your own discretion and risk, and you will not hold Forxers or any of its team members or users liable for any losses or damages.
8. Risk Disclosure for Forex Trading
Trading foreign currencies (forex) carries significant risk. Because our platform is about forex trading education, it is crucial that all users understand and acknowledge the inherent risks involved in trading. Forxers does not guarantee any results; in fact, you should be prepared for the possibility of financial loss. Key points regarding risk include:
- Potential for Loss: Forex trading involves leverage and volatility, meaning you can lose some or all of the money you invest, and potentially more if you are using margin. It is possible to have losing trades or even a string of losing trades. You should only trade with funds that you can afford to lose without affecting your livelihood.
- No Guaranteed Outcomes: Past results do not guarantee future success. Just because a strategy or a trader performed well in the past (or in back-testing) does not mean it will perform well in the future. Market conditions change and no strategy is foolproof. Forxers may showcase historical examples or member success stories, but these are not predictors of identical future performance for you .
- Market Risks: The forex market can be affected by factors beyond anyone’s control – such as global economic news, geopolitical events, unexpected market liquidity issues, etc. These events can cause rapid and substantial price movements. You should be aware that you might not always be able to execute trades at desired prices (slippage), and in extreme cases, you might face difficulties exiting a position.
- No “Get Rich Quick”: We caution you against any mentality of quick profits. Trading is a skill that requires practice, and even experienced traders have bad days. Do not assume that paying for Forxers or any education will automatically make you profitable. It provides knowledge and community support, but your trading results depend on your own efforts, decisions, and market conditions.
- Psychological and Technical Risks: Trading can be highly stressful. Emotional decision-making can lead to mistakes. Also, technology can fail — e.g., trading platform outages, internet disconnections, or software bugs can lead to losses. These are part of the trading risk environment.
- Seek Professional Advice if Needed: If you are ever in doubt about understanding these risks, or about the suitability of trading for your situation, consult a licensed financial advisor. Nothing on our Platform is a substitute for personalized professional advice.
By continuing to use our educational Services, you acknowledge and accept the risks of forex trading. Forxers and its contributors will not be responsible for any trading losses you might incur as a result of using information obtained through the Platform. You agree to use the knowledge gained responsibly and at your own risk.
9. Subscription Plans, Fees, and Payments
Forxers offers certain premium educational content and community access through subscription-based membership plans. The terms in this section apply to any purchase of a subscription or other paid services from Forxers.
9.1 Subscription Services: Subscription membership may provide you with benefits such as access to exclusive content (e.g., advanced courses, live mentoring sessions, special Discord channels), tools, or other resources. The specific features and pricing of the subscription will be stated at the point of purchase. By subscribing, you agree to pay any applicable fees and abide by any additional terms presented to you at sign-up.
9.2 Third-Party Payment Processor (Selar): At present, Forxers uses a third-party payment platform, Selar (selar.co), to process subscription payments and manage the subscription access. This means when you decide to purchase a subscription, you may be redirected to Selar’s website or interface to enter your payment details and complete the transaction. Selar is an independent service – Forxers does not collect or store your full payment card details. Any payment information you provide is given directly to Selar (or the payment gateway Selar uses), and their terms and privacy policy will govern that transaction. By making a payment, you agree to Selar’s terms of service as well. We are not responsible for any errors or issues that occur on Selar’s platform, but we will do our best to assist in resolving them if possible.
9.3 Payment of Fees: You must provide a valid payment method (e.g., a credit/debit card or other supported payment option) through the payment processor to subscribe. You authorize the charging of the subscription fee to your provided payment method. All prices are listed in Nigerian Naira (₦) unless otherwise stated, and they include any applicable taxes unless specified. If your payment method fails or is declined, we may suspend or revoke your access to subscription content until you provide a new valid payment and the charge is successful.
9.4 Recurring Billing and Auto-Renewal: Forxers subscriptions operate on a recurring billing cycle (e.g., monthly or annually, depending on the plan you choose). This means that unless you cancel your subscription, you will be automatically charged at the next interval (for example, each month on the same date as your original sign-up, or each year on the anniversary of sign-up). By subscribing, you authorize Forxers and/or the third-party processor to automatically charge your payment method on each renewal date. We will indicate during purchase whether your plan auto-renews and the interval of renewal. It is your responsibility to cancel in time if you do not want to renew.
9.5 Cancellation of Subscription: You may cancel your subscription at any time if you no longer wish to continue. Cancellation prevents future renewal charges, but does not automatically entitle you to a refund for the current period (see Section 10 on Refunds). To cancel, follow the instructions provided at purchase (this may involve logging into Selar or contacting Forxers support). Typically, you will maintain access to the subscription features until the end of the current paid term, after which the membership will not renew and access will downgrade or cease. We recommend cancelling at least 48 hours before your next billing date to ensure the cancellation processes in time.
9.6 Changes in Fees: Subscription fees may change over time (for instance, we may adjust pricing or offer new plans). If the price of your subscription is due to change, we will notify you in advance (generally via email or through the Platform). Fee changes will not apply retroactively – they would take effect at the start of your next billing cycle following the notice, if you choose to continue. If you do not agree to a price change, you may cancel your subscription before the new rate takes effect. Continuing to use the subscription after the price change constitutes acceptance of the new price.
9.7 Temporary Third-Party System: As noted, our use of Selar is intended as a temporary solution until our custom site and payment system are ready. Once our own platform is operational, we may migrate subscription management in-house or to a different payment provider. We will provide clear instructions and notice to subscribers about any change in payment processing or account migration. During any such transition, we will strive to ensure continuity of service for paid members. Your membership status (active vs. expired) will carry over to the new system, and these Terms (as updated) will continue to apply.
10. Refund Policy
Forxers provides digital educational content and community access. Due to the nature of our services (intangible, immediate access to valuable content and community once a subscription is activated), we maintain a no-refund policy under most circumstances. We set out this policy clearly to be transparent and to avoid misunderstandings:
- All Sales Are Final: Payments for subscriptions or any one-time purchases on Forxers are generally non-refundable. Once you have been granted access to our online content or community, the service is considered delivered and consumed. We cannot “take back” the knowledge or insights you may have obtained, so we do not offer refunds for subscription fees simply because you changed your mind or didn’t utilize the services.
- Exceptional Circumstances: While our default stance is no refunds, we understand that genuine issues can arise (for example, accidental duplicate payments, or a serious unforeseen hardship). In such cases, you may contact Forxers support to explain the situation. Any refund outside of our standard policy will be at our sole discretion and reviewed on a case-by-case basis. Granting a refund in one instance does not obligate us to do so in the future for similar instances. We also may provide account credit or defer your subscription instead of a cash refund, at our discretion.
- Compliance with Law: If Nigerian law or other applicable consumer protection laws require a refund in a given situation, we will of course comply with the law. For example, if any “cooling-off” period or mandatory refund right applies to online subscriptions under local law (if any), those rights are not waived. However, to our knowledge, no such specific regulation prevents a no-refund policy for the type of service we offer once access is granted. We make this clear so you can make an informed purchasing decision.
- Chargebacks and Dispute Resolution: We strongly encourage users to contact us first if they encounter any billing issues or dissatisfaction, rather than directly initiating a chargeback or dispute with their bank. If you initiate a chargeback or payment dispute for a charge that is valid under these Terms (e.g., an auto-renewal you forgot to cancel), we reserve the right to contest the chargeback and provide these Terms and your acceptance as evidence that the charge was authorized. Additionally, initiating a chargeback in bad faith (for example, to avoid our no-refund policy after consuming our content) may result in immediate termination of your account for misuse. We value fairness and transparency: we will be fair in reviewing any refund requests, and we ask you to be fair by respecting this policy.
- Maintaining Trust: We disclose our no-refund policy up front to maintain trust with our users. Our goal is to deliver high-quality educational content and community support. If you are ever unsatisfied or feel something was misrepresented, please let us know – while refunds are not guaranteed, we want to address legitimate grievances and improve our offerings.
In summary, by purchasing a subscription or service from Forxers, you acknowledge that you are not entitled to a refund except as explicitly described above. Please ensure a Forxers subscription is right for you before purchasing. If you have questions about what’s included, contact us for more information before you buy.
11. Intellectual Property Rights (Forxers Content)
11.1 Forxers Materials: All content provided by Forxers through the Platform – including but not limited to text, videos, webinars, PDFs, graphics, logos, software, and any educational materials (“Forxers Content”) – is the property of Forxers or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. Forxers retains all rights, title, and interest in and to its Content. The Forxers name, logo, and all related names and graphics are trademarks/service marks of Forxers. You do not acquire any ownership in our intellectual property by using our Services or by paying for a subscription.
11.2 Personal License: Subject to your compliance with these Terms and any applicable subscription fees, Forxers grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Forxers Content for your personal, non-commercial educational use only. This means you may watch our videos, read our materials, and use them for your own learning. You may not copy, reproduce, redistribute, republish, resell, or broadcast any Forxers Content to anyone else without our prior written permission. For example, you cannot take our course materials and upload them to another site, or share member-only analysis outside the community. If you want to share something, ask us – we often encourage sharing snippets or general knowledge, but wholesale copying is not allowed.
11.3 Restrictions: You agree not to:
- Remove or alter any copyright, trademark, or proprietary notices on Forxers Content.
- Use any logos or graphics belonging to Forxers without our express permission.
- Reverse engineer, decompile, or disassemble any of our software or digital materials.
- Use Forxers Content for the benefit of any third party or in any manner not permitted by these Terms (for instance, as part of your own course or business).
11.4 User Content Ownership: As stated in Section 6, you retain ownership of content you personally create and share. Nothing in this Section 11 takes ownership of your own posts or creations away from you. Our intellectual property clause primarily protects content created by Forxers. User-generated content is governed by the license you grant us in Section 6.2. If you believe someone else’s content on our Platform infringes your intellectual property, please notify us immediately with details so we can investigate (provide your contact info, proof of ownership, and the infringing material’s location).
11.5 Forxers Marks: You may not use the “Forxers” name or any logos, slogans, or trademarks of Forxers in any way (e.g., to imply endorsement or partnership) without our prior written consent. The only exception is that you may truthfully state that you are a member of the Forxers community or a student of the platform, as long as you do so in a way that is not misleading or defamatory, and you do not combine our name with any objectionable content. For any press or media inquiries about using our brand, please contact us.
12. Account Suspension and Termination
12.1 By Forxers (Termination for Cause): Forxers reserves the right to suspend, deactivate, or terminate your account or access to certain parts of the Services at any time, with or without notice, if we reasonably believe that: (a) you have violated any provision of these Terms or any community guidelines; (b) you have engaged in fraudulent, unlawful, or improper use of the Platform; (c) your behavior is abusive, excessively disruptive, or harmful to the community or to other users; or (d) you are using the Platform in a way that could cause us legal liability or harm (including reputational harm). Termination for cause is immediate and at our sole discretion. For example, cheating other users, harassing members, sharing pirated content, or attempting to hack our systems are all grounds for immediate termination.
12.2 By Forxers (Inactivity or Other Reasons): In addition, we may deactivate or remove accounts that have been inactive for a prolonged period. If you have not logged into the Platform or shown any activity for an extended time (typically, six months or more), we may flag your account as inactive. We reserve the right to deactivate such accounts to maintain an active community and manage resources. In practice, we might attempt to reach out via your registered email before deactivation, but we are not obligated to do so. If your account is deactivated for inactivity, you may contact us to request reinstatement, but note that content associated with the account might have been removed or archived. We may also terminate accounts due to operational changes (for instance, if we discontinue the Discord server in favor of another platform, etc., though we would aim to migrate active users in that case).
12.3 By You (Voluntary Termination): You have the right to stop using our Services and/or delete your account at any time. On Discord, you can simply leave the server; for subscriptions, you can cancel as described in Section 9. If in the future we have account dashboards on our own site, we will provide a mechanism to delete your account or you can request deletion via support. Keep in mind that leaving the community or deleting your account does not automatically entitle you to any refund of fees already paid (see Refund Policy in Section 10). Also, even after you delete your account, some content you posted (that is not personally identifiable) may remain, as per the license in Section 6 (for example, messages in Discord may remain visible to others unless you manually delete them before leaving).
12.4 Effect of Termination: Upon termination or suspension of your account for any reason: (a) your right to access the Platform and any Forxers Content immediately ceases; (b) if you were a subscriber, we may revoke access to any premium areas or materials; (c) we may delete or deactivate your profile and other information associated with you, though we might retain certain data as required or permitted by law or our Privacy Policy (e.g., transaction records, communications about your termination, etc.). If termination was due to your breach of Terms, we reserve the right to refuse re-registration or reactivation of your account, or to limit you from future use of our Services.
12.5 No Liability for Termination: Forxers will not be liable to you or any third party for any termination or suspension of your account, or for removal of your content. Termination of an account is without prejudice to any rights or remedies we may have accrued up to the date of termination (for example, we can still pursue legal action for conduct that violated these Terms prior to termination).
12.6 Reinstatement: If you believe your account was suspended or terminated in error, you may contact us to appeal the decision. We may, in our sole discretion, decide to reinstate an account if we find compelling evidence or assurances of future compliance. However, we are not obligated to do so and our decisions on these matters are final.
13. Communications and Electronic Notices
13.1 Consent to Receive Communications: By creating an account or providing your contact information to Forxers, you consent to receive communications from us electronically, such as via email, direct messages on the Platform (including Discord announcements or DMs from moderators/bots), or via notices posted on our website or community channels. These communications may include onboarding information, product updates, community news, educational resources, marketing/promotional materials, or other notices. For example, after sign-up you might receive a welcome email series with tips on using Forxers, or emails announcing new course releases or community events.
13.2 Opting Out of Marketing Emails: If you no longer wish to receive certain types of communications, particularly promotional or newsletter emails, you will have the option to unsubscribe. Every marketing email from us will include an “unsubscribe” link at the bottom. You can click that to opt out of future marketing emails. Alternatively, you can adjust your preferences in your account settings (if available) or contact support to be removed from mailing lists. However, you cannot opt out of essential service-related communications, as noted below.
13.3 Service and Transactional Messages: Forxers may still send you important administrative or account-related messages, even if you opt out of marketing. These include messages such as subscription confirmations and receipts, password reset emails, critical updates to these Terms or our Privacy Policy, security alerts (e.g., if we detect unusual account activity), or other important notices about your use of the Platform. We generally send these to your registered email address or through in-app notices. It is your responsibility to keep your contact information up to date so that you can receive such communications.
13.4 Message Frequency: If you join our community on Discord, we may tag everyone or send announcements periodically, but we aim to keep communications reasonable. Email frequency will vary based on your engagement— for instance, new subscribers may get a few onboarding emails in the first weeks, and thereafter perhaps a weekly or biweekly update. You can control some frequency by adjusting preferences (e.g., opting into a monthly summary instead of frequent updates if we offer that option).
13.5 Data Rates and Notifications: If we ever enable SMS alerts or mobile app notifications (in the future on our custom platform), note that standard messaging/data rates may apply based on your carrier plan. Currently, our communications are primarily via email and Discord.
13.6 Community Correspondence: Apart from official communications from Forxers, other members or mentors might send you direct messages (for example, a mentor might DM you on Discord if you asked a question). While we encourage helpful interactions, you are not required to respond to any message that makes you uncomfortable, and you can report inappropriate communications to a moderator or admin. Forxers will handle reports of abuse or spam in communications between members per our guidelines.
By using our Platform and providing your contact info, you agree that communications from us electronically satisfy any legal requirement that such communications be in writing. For any questions about communications or if you are experiencing issues receiving them, please contact our support.
14. Third-Party Links and Services
14.1 Third-Party Content: The Platform or communications from Forxers may include references or links to third-party resources, websites, or content (for example, a link to a news article, or a recommended broker’s site, or the Selar payment gateway). These are provided for convenience or informational purposes. Forxers does not endorse and is not responsible for any third-party content, products, or services. If you access third-party websites or resources, you do so at your own risk, and different terms and privacy policies may apply to your use of those sites.
14.2 Discord Platform: As detailed earlier, our community leverages the Discord service. Discord is a third-party platform, and by using it you are subject to Discord’s own Terms of Service and Privacy Policy. Forxers is not responsible for Discord’s operations, data handling, or any acts or omissions by Discord. If Discord’s platform becomes unavailable or if your Discord account is suspended by Discord, this may affect your ability to use our Services, and such issues are outside Forxers’ control. We will do what we can to assist (for example, if Discord bans your account incorrectly, we can help you appeal, but we cannot guarantee success).
14.3 Payment Processing (Selar): Likewise, payments for subscriptions are handled by Selar or possibly by payment gateways integrated by Selar (like Paystack, Flutterwave, etc., depending on what Selar uses). Any transaction is subject to the terms of those payment providers. Forxers does not receive your full card information; we rely on secure processing by those third parties. We are not liable for any payment issues arising from faults on the payment provider’s side (such as double-charges, card info breaches, etc.), though we will support you in contacting them or resolving issues as feasible. It’s a good practice to review Selar’s terms and the payment receipt they provide for any additional conditions.
14.4 External Advice and Partners: From time to time, Forxers or community members might mention external services (like a particular broker, trading platform, analytical tool, or another educational resource). Unless explicitly stated, these mentions are not official endorsements by Forxers. Always do your own due diligence before using any third-party services or following advice. If we do form an official partnership or referral program (for instance, an affiliate broker link for members), we will disclose that relationship. Even in those cases, any transaction you undertake with a third-party (e.g., opening a brokerage account) is solely between you and that third-party.
14.5 No Liability for Third-Party Actions: To the fullest extent permitted by law, Forxers disclaims any liability for losses or damages you may incur by interacting with or as a result of third-party websites or services, even if you learned of them through our Platform. This includes, but is not limited to, losses from: using a broker or exchange, downloading third-party software, trusting content from another website, or any disputes with other users on an external platform. Your business dealings or correspondence with third parties (and any terms, conditions, warranties associated with such dealings) are solely between you and the relevant third party.
14.6 Connections to Other Users: Keep in mind that any personal information or contact details you choose to share with other users (for example, you decide to collaborate with someone and give them your email/phone) is at your discretion. We advise caution and common sense when extending interactions beyond our official channels. Forxers is not responsible for any offline or off-platform agreements or interactions.
15. Disclaimers of Warranties
15.1 “As Is” Service: Forxers provides the Platform and all content on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. While we strive to offer high-quality educational content and a reliable community experience, we make no representation or warranty that the Services will be uninterrupted, error-free, or free of harmful components (such as viruses). Use of the Platform is at your own risk.
15.2 No Warranty of Accuracy or Outcomes: Forxers does not warrant or guarantee that the information provided on the Platform is accurate, complete, or up-to-date. Forex markets change rapidly, and educational content can become outdated. We will try to update materials, but we make no promise to do so on any particular schedule. We explicitly disclaim any warranty that following any strategies or information on our Platform will result in profitable trades or desired outcomes. Trading outcomes are influenced by many factors beyond our control (and indeed beyond anyone’s control).
15.3 Implied Warranties: To the maximum extent permitted by applicable law, we disclaim all implied warranties or conditions, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. For example, we do not guarantee that our educational content is fit for your particular trading goals, or that it will meet your expectations. We do not guarantee that the Platform will be compatible with your device or that it will be available in your region without error.
15.4 No Liability for Data Loss or Software Issues: You are responsible for ensuring you back up any data you may have (for instance, if you take notes on our site in the future, or any messages you want to save from Discord). We are not responsible for loss of data or content you provided due to routine maintenance or unexpected outages. We also are not responsible for any damage to your computer system or mobile device that might result from downloading or accessing any material through the Services (for example, if files are downloaded). We believe our Platform is safe, but standard internet risks apply.
15.5 Beta Services: If Forxers offers any new features or tools on a “beta” basis (trial or test features), those are provided without any warranty whatsoever and solely as an accommodation. We reserve the right to modify or remove them at any time.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, any applicable implied warranties shall be limited to the minimum scope and duration permitted by law.
16. Limitation of Liability
16.1 Cap on Liability: To the fullest extent permitted by law, in no event shall Forxers, its founders, instructors, mentors, employees, partners, or affiliates be liable for any indirect, incidental, special, consequential or exemplary damages arising out of or in connection with your use of (or inability to use) the Platform or any Forxers content. This includes, without limitation, any loss of profits, lost opportunities, trading losses, loss of data, loss of goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.
16.2 Direct Damages Limit: To the extent that the above limitation is held unenforceable or does not fully cover a situation, you agree that the total aggregate liability of Forxers and its affiliates for any claims arising out of or related to these Terms or your use of the Services, regardless of the form of the action (whether in contract, tort, negligence, strict liability or otherwise), shall not exceed the amount you have paid to Forxers in subscription or service fees in the twelve (12) months immediately prior to the event giving rise to the claim. If you have not paid any amount (for example, using free aspects of the Platform), our total liability shall be zero to the extent permissible by law.
16.3 Release of Claims: You hereby release Forxers and its officers, directors, employees, and agents from any and all obligations, liabilities, and claims in excess of the limitations stated in this section. If you are dissatisfied with any part of the Service or with any of these Terms, your sole and exclusive remedy is to discontinue use of the Service.
16.4 Third-Party Liability: Forxers will not be responsible for any liability arising out of content provided by any user or third party (such as an instructor’s materials, or Discord’s platform issues), or for any damage that might be caused by third-party services we do not control (like internet providers, payment processors, etc.). You acknowledge that other users, not Forxers, are solely responsible for their own content and postings, and you may pursue a claim against a user separately if they cause harm, but not against Forxers for others’ actions.
16.5 Basis of the Bargain: You agree that the above limitations of liability are essential terms of this agreement and that Forxers would not be able to provide the Services on an economically feasible basis without these limits. Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so certain of the above limitations may not apply to you. In such cases, liability is limited to the fullest extent permitted by law.
17. Indemnification
You agree to indemnify, defend, and hold harmless Forxers, its founders, instructors, mentors, employees, agents, and affiliates, from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) that arise from or relate to: (a) your use or misuse of the Platform (including any content you post, or any trading decisions you make based on Platform content); (b) your violation of these Terms or any policy incorporated by reference; (c) your violation of any law or regulation or the rights of any third party (for example, if you post someone else’s copyrighted material and we get sued, or if you use the Platform to commit fraud, etc.); or (d) any claim that you have provided false, inaccurate, or misleading information leading to harm.
Forxers reserves the right, at our own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you agree to cooperate with us in asserting any available defenses). This means if we choose, we can take charge of the legal defense of a claim against us that you are responsible for, and you will cover the costs or reimburse us. You agree not to settle any such matter without the prior written consent of Forxers. We will make reasonable efforts to notify you of any claim or proceeding that is subject to indemnification as soon as we become aware of it.
This indemnification obligation will survive any termination of your account or the Services. It basically lives on after our relationship ends, covering events that occurred while you used the Platform.
18. Governing Law and Jurisdiction
These Terms and your use of the Forxers Platform are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Services shall be subject to the exclusive jurisdiction of the courts of Nigeria.
In particular, unless otherwise required by a specific law (such as a consumer protection law that mandates a different forum), you agree that Nigerian courts have sole jurisdiction. If you are accessing the Platform from outside Nigeria, note that you are still agreeing that Nigerian law governs your use and that you will submit to the jurisdiction of Nigeria’s courts in the event of any dispute.
Jurisdiction and Venue: If any litigation is to occur, it shall be in the courts located within Nigeria. We (you and Forxers) each waive any objection to the venue of such courts, including any claim that such legal action has been brought in an inconvenient forum.
Please be aware that by agreeing to these Terms, you are explicitly choosing Nigerian law as the law to govern all interactions between you and Forxers, and you are waiving any rights to claim that another jurisdiction’s law applies or to claim that courts elsewhere should hear the case. This clause does not prevent us from seeking injunctive relief or any urgent legal remedy in any appropriate jurisdiction if necessary to protect our interests, but the interpretation of the Terms themselves remains under Nigerian law.
19. Changes to These Terms
Forxers may modify or update these Terms and Conditions from time to time to reflect changes in our services, user feedback, or legal requirements. Whenever we update the Terms, we will also update the “Last Updated” date at the top of the Terms page (if provided on the website) or inform you in the changelog of our Discord/announcements.
19.1 Notification of Changes: For significant changes, we will endeavor to notify users through appropriate channels – for example, by sending an email to the address associated with your account, or by posting a prominent notice in the community or on our website. What constitutes a “significant” change is at our discretion, but generally it would be something like a change in our dispute resolution process, a new fee, or an update that affects your rights or obligations in a notable way.
19.2 Acceptance of Changes: Once updated Terms are posted and/or communicated, they will be effective. By continuing to use the Platform after the new Terms have become effective, you are deemed to accept the changes. If you do not agree to the revised Terms, you should stop using the Platform and, if applicable, cancel any subscriptions (though note that the then-current Terms still govern any past usage and any outstanding obligations).
We recommend that you review these Terms periodically to stay informed of any updates. We aim to not change Terms too frequently, but as our services evolve, adjustments may happen.
20. Miscellaneous Provisions
20.1 Entire Agreement: These Terms, together with our Privacy Policy and any other policies or guidelines posted to the Platform (which are incorporated by reference), constitute the entire agreement between you and Forxers regarding your use of our Services. They supersede any prior agreements, communications, and proposals (whether oral, written, or electronic) between you and us with respect to the Platform. Any additional or different terms you may propose (for example, in correspondence) are rejected unless expressly agreed in writing by an authorized representative of Forxers.
20.2 Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of the Terms will remain in full force and effect. In other words, the invalid part will be cut out or modified as little as necessary, and the rest of the agreement stands.
20.3 No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Forxers. For example, if we do not immediately act on a violation by you, that does not mean we are giving up our right to act on it or similar issues in the future.
20.4 Assignment: You may not assign or transfer your rights or obligations under these Terms to anyone else without our prior written consent. Forxers may assign or transfer our rights and obligations under these Terms freely to an affiliate or in connection with, for instance, a merger, acquisition, corporate reorganization, or sale of assets, or by operation of law. These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
20.5 Force Majeure: Forxers shall not be liable for any delay or failure in performance of the Services (including outages or inability to access content) resulting from events outside our reasonable control, such as natural disasters, war, terrorism, riots, embargoes, government regulations, fire, strikes, pandemic-related disruptions, or failures of telecommunications or internet service providers (collectively, “Force Majeure”). We will attempt to minimize disruptions but make no guarantee in such scenarios.
20.6 Relationship of Parties: Nothing in these Terms shall be construed to create a joint venture, partnership, employment, or agency relationship between you and Forxers. You are an independent user of the Platform, and neither party has the authority to bind the other or incur obligations on the other’s behalf.
20.7 Headings and Interpretation: Section headings in these Terms are for convenience only and have no legal or contractual effect. In interpreting these Terms, no against-the-drafter presumption shall apply; these Terms are agreed upon by both parties. Words like “including” shall be interpreted to mean “including without limitation.”
20.8 Survival: Provisions of these Terms that by their nature should survive termination (such as disclaimers, limitation of liability, indemnification, governing law, etc.) will survive any termination or expiration of these Terms and/or your use of the Services.
